The Forest of Nisene Marks
AMENDED GENERAL PLAN/FINAL EIR
An Amended General Plan/Final EIR has recently been prepared for The Forest of Nisene Marks State Park.
This Amended General Plan/FEIR (July 2005) was made necessary as a result of a stipulated court settlement on April 8, 2005, which determined that because of deed restrictions imposed by the Marks Family, mountain biking would not be allowed in approximately 9,000 acres of the park above the Soquel Augmentation Line, except on the Aptos Creek Fire Road.
Necessary revisions to reflect the court’s decision were made in the General Plan/Final EIR that was previously approved by the State Park and Recreation Commission on August 22, 2003. Although mountain biking is more restricted in the park, there is no change necessary to the findings in the Final EIR previously certified by the Commission. The Amended General Plan/FEIR includes the revised language related to mountain biking, as well as incorporation of the recommended staff revisions and public review text changes approved by the Commission in August 2003. An Addendum to the GP/FEIR has been prepared that summarizes these revisions.
